‘Unhinged claim,’ say couple sued by neighbors over ‘cover-up on $1million hot tub & spa conflict of interest violation’

A COUPLE has been sued by an outraged neighbor for allegedly covering up claimed violations.

Bob Theobald originally filed a lawsuit against Park City Planning Commission Chair Sarah Hall and her husband Gerry in May 2023.

Theobald claimed that the couple violated building and land use rules while renovating their 7-acre property in the Park Meadows area of Park City, Utah.

Now, Theobald is arguing that Halls manipulated community HOA rules, known as covenants, conditions, and restrictions (CC&Rs), to cover their tracks.

“This is Mr. Theobald’s most absurd and unhinged claim yet,” Gerry told local public radio station KPCW.

“It’s merely another chapter in his conspiracy theory tirade he’s been on for the last three years.

“It’s egregious and audacious,” Theobald told KPCW.

“It’s very special, sensitive land.”

The angry neighbor claims the Halls disrupted sensitive wetlands, planted trees that blocked regulated viewsheds, and built a hot tub without the proper permit.

Hall’s attorney and the city claim the application for the $1 million home remodel was submitted, approved, and paid for without opposition more than two years ago.

Theobold submitted a complaint a year later in opposition to their renovation.

He also claims Hall used her authority on the planning commission to loosen rules around hot tub and spa permits, to keep her home renovation in line.

Halls has not commented on Theobald’s accusations.

Gerry, however, claims the HOA rule changes were made months before they began renovating their home.

“Our HOA amended the CC&Rs by unanimous consent of the HOA members and not any one individual,” said Gerry.

“This is normal course of business for the multitudes of HOAs throughout Park City.

“Our CC&Rs hadn’t been updated in nearly 30 years and were in need of modernization.

“The amendments were wide-ranging including updates to the architectural standards, color palettes, fractional ownership rules, solar panels, etc.”

Theobold is also suing the city for lack of proper oversight on the Halls’ renovations.

The U.S. has reached out to Park City for comment.
