LASBCA threatens prosecution over building control violations

The Lagos State Building Control Agency has issued a stern warning to building professionals in the state, emphasising the need for strict compliance with building control regulations amid a rise in structural defects and building collapses.

In a statement signed by its Director of Public Affairs, Adu Ademuyiwa, and made available to The PUNCH, the agency said all developers and construction professionals must adhere to approved building plans, obtain valid planning permits before commencing construction, and secure mandatory stage certifications throughout the building process.

The agency expressed concern that many of the recent building failures in Lagos State were linked to regulatory violations, including unauthorised alterations to approved plans and failure to obtain statutory approvals.

“These requirements are not mere administrative procedures, but critical safeguards designed to ensure structural integrity, public safety, and orderly urban development,” the agency stated.

The General Manager, Gbaye Florence, said the agency would adopt a zero-tolerance approach to non-compliance, warning that erring professionals would face sanctions and possible prosecution.

“Building professionals owe a duty of care to the public. Any compromise, whether through deviation from approved plans, failure to obtain permits, or neglect of stage certifications, poses a serious threat to lives and property.

“LASBCA will not hesitate to report erring professionals to their respective regulatory bodies for appropriate disciplinary action,” she added.

Florence described failure to obtain stage certifications as a grave violation, noting that such inspections were essential for verifying compliance and ensuring safety standards at every phase of construction.

According to her, offenders risked being referred to their professional associations and could face prosecution under existing laws governing building control in the state, particularly in cases involving unauthorised developments.

The agency also disclosed that it had strengthened its monitoring mechanisms to promptly detect and address violations, with particular focus on projects without planning permits and those lacking required stage approvals.

It urged developers, consultants and contractors to collaborate with regulatory authorities in upholding best practices, while advising property owners to engage only qualified and registered professionals committed to due process.

“As Lagos continues to experience rapid urban growth, strict compliance with building control regulations remains indispensable to achieving a safe, resilient, and sustainable built environment,” the statement added.
